In consideration of JP Sports, a division of JP Sports and Event Management, LLC (“JP Sports”) furnishing services, lessons, facilities and/or equipment to enable me or my child to participate in baseball and softball training or practice activities, camps, leagues, or tournaments (collectively, the “activities”). I agree as follows: I fully understand and acknowledge that: a) risks and dangers exist in my or my child’s use of baseball and softball training facilities and equipment; b) my or my child’s participation in the Activities and/or us of such facilities and equipment my result in my or my child’s injury or illness including but not limited to bodily injury, disease, strains, fractures, partial and/or total paralysis, eye injury, blindness, heat stroke, heart attack, COVID-19 other ailments that could cause serious disability or death; c) these risks and dangers may be caused by the negligent acts of omissions of the owners, employees, officers, members, manager or agents of this facility, the negligent acts of omissions of participants, the negligent
acts of omissions of others, reckless acts, intentional acts, breaches of contract, forces of nature or other causes. These risks and dangers may arise from foreseeable or unforeseeable causes; and d) by my or my child’s participation in the Activities and/or use of the facilities and/or equipment, I, individually and on behalf of my child, hereby assume all risks and danger and all responsibility for any losses and/or damages, whether caused in whole or in part by the negligence or other conduct of the owners, agents, officers, members, managers, employees of JP Sports or JP Sports and Event Management LLC, or any other persons. I, on behalf of myself, my child, and the personal representatives and heirs of my child or me, hereby voluntarily agree to and hereby effectively do release, waive, discharge, hold harmless, defend and indemnify JP Sports and JP Sports and Event Management, LLC and its owners, agents, officers, and employees from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of services or otherwise which may arise out of my use of baseball and softball training equipment or practice facilities or equipment my or my child’s participation in the activities. I specifically understand that I am releasing, discharging and waiving any claim or actions that I or my child may have presently or in the future for the acts or other conduct by the owners, agents, officers, members, managers or employees of JP Sports and Event Management, LLC. Should any provision of this Waiver and Release be determined unenforceable by a court of law, this Waiver and Release may be revised to waive and release my rights to the greatest extent allowed by law, since this is my intent in signing this document. I HAVE READ THE ABOVE WAIVER AND RELEASE AND BY SIGNING IT AGREE IT IS MY INTENTION TO EXONERATE AND RELIEVE JP Sports and Event Management, LLC FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH CAUSED BY NEGLIGENCE OR ANY OTHER ACT OR OMISSION. THIS IS A RELEASE OF LIABILTY. By signing this form, you are also allowing JP Sports and Event Management, LLC to use any photos taken of any player and/or coach for marketing and advertising purposes.
